COURT TOSSES LAWSUIT BY COP WHO LOST THUMB.(Capital Region)

ALBANY -- An Albany detective whose thumb was shot off by an Albany County sheriff's investigator during an ill-planned investigation three years ago cannot sue the county agency for his injuries, a state appellate court ruled today.

The decision at least temporarily scuttles the lawsuit of Detective Jeffrey Connery, who was wounded Sept. 6, 2007, when he and two sheriff's investigators unexpectedly came upon a man holed up in a remote cabin.

The investigators were on their way to pull up marijuana plants in Berne and ended up in a struggle with the man and his dog, a large Akita mix that attacked Connery during the encounter.
